This article analyses the current legal protection schemes of non-personal data. Having concluded that there is a lack of comprehensive protection, it assesses whether such protection is desirable at all. A market and innovation analysis shows that a new IPR on data might not be justified. Finally, a proposal for a new Directive on Data Access will be presented, which balances the needs of a digital economy and legal protection of its participants.
