1. Definition
Civil litigation is litigation involving all matters other than criminal matters. In any civil case there will be two parties, the claimant, who was known as the plaintiff prior to the introduction of the Civil Procedure Rules 1998, and the defendant. The standard of proof in civil cases is on „the balance of probabilities“.
