Frederick Schauer reminds us of the important question we tend to forget in our everyday working life: What are constitutions for? What aim do they serve? His answer goes as follows: “[C]onstitutionalism is a series of second-order rules that exclude a range of first-order policy reasons from official consideration – even those that might be otherwise sound."¹¹ Schauer, Constitutionalism and Coercion, Boston College Law Review 54 (2013), 1881 (1895); see also 1883 and 1894.
