Assignment of future claims and bankruptcy of the assignor
When future claims are assigned and the assignor becomes bankrupt, the question arises whether the assignee or the bankrupt's estate is entitled to the claims. The answer is difficult. It is, however, of particular practical importance in the case of assignments for security purposes or factoring. The author attempts to further develop solutions pointed out so far while taking into consideration basic principles of bankruptcy law. The particularities of rental claims are dealt with extensively.
