Änderung des Art. 26 der Satzung des Europarats

Certificate of the Secretary General of the Council of Europe

Whereas paragraph d of Article 41 of the Statute of the Council of Europe provides that amendments to Articles 23 to 35, 38 and 39 which have been approved by the Committee of Ministers and the Consultative Assembly shall come into force on the date of the certificate of the Secretary General, transmitted to the governments of members, certifying that they have been so approved.

The Secretary General hereby certifies as follows:

1. 1. The Committee of Ministers, by the adoption on 14 June 2006 of a Decision noting that the Republic of Serbia is continuing the membership of Serbia and Montenegro in the Council of Europe, with effect from 3 June 2006, approved the amendment to Article 26 of the Statute, the text of which is set out below;
2. 2. The Parliamentary Assembly had proposed the same amendment in a letter of 9 June 2006 from the President of the Parliamentary Assembly to the President of the Committee of Ministers;
3. 3. Both organs of the Council of Europe having thus approved it, the amendment come into force this 14th day of June 2006, being the date of this certificate, transmitted to the governments of members.

The amended text of Article 26 is worded as follows:

“Members shall be entitled to the number of Representatives given below:

Procs-verbal du Secrtaire Gnral du Conseil de l'Europe

Considrant que le paragraphe d de l'article 41 du Statut du Conseil de l'Europe nonce que les amendements aux articles 23 35, 38 et 39, qui auront t approuvs par le Comit des Ministres et l'Assemble Consultative, entreront en vigueur la date du procs-verbal ad hoc tabli par le Secrtaire Gnral, communiqu aux gouvernements des membres et attestant l'approbation donne auxdits amendements.

Le Secrtaire Gnral certifie, par les prsentes, ce qui suit:

1. 1. Le Comit des Ministres, en adoptant le 14 juin 2006 une Dcision qui prend note du fait que la Rpublique de Serbie continue assumer la qualit de membre du Conseil de l'Europe jusqu' prsent dvolue la Serbie-Montngro, avec effet au 3 juin 2006, a approuv l'amendement l'article 26 du Statut et a libell le texte dans la forme reproduite ci-dessous;
2. 2. L'Assemble Parlementaire avait propos le mme amendement dans une lettre adresse le 9 juin 2006 par le Prsident de l'Assemble Parlementaire au Prsident du Comit des Ministres;
3. 3. Cet amendement, ainsi approuv par les deux organes du Conseil de l'Europe, entre en vigueur le 14 juin 2006, date du prsent procs-verbal, communiqu aux gouvernements des membres.

Le texte amend dudit article 26 est libell comme suit:

Bescheinigung des Generalsekretärs des Europarats

Nachdem Art. 41 Abs. d der Satzung des Europarats ¹¹ Kundgemacht in BGBl. Nr. 121/1956, zuletzt geändert durch BGBl. III Nr. 151/2004 idF BGBl. III Nr. 95/2005 vorsieht, dass Änderungen der Artikel 23 bis 35, 38 und 39 nach ihrer jeweiligen Billigung durch das Ministerkomitee und die Beratende Versammlung mit dem Datum der vom Generalsekretär ausgestellten Bescheinigung, die den Regierungen der Mitglieder zu übersenden ist und die Billigung der genannten Änderungen beglaubigt, in Kraft treten, beglaubigt der Generalsekretär hiemit wie folgt:

1. 1. Das Ministerkomitee, das am 14. Juni 2006 einen Beschluss angenommen hat, wonach die Republik Serbien die Mitgliedschaft von Serbien und Montenegro mit Wirkung vom 3. Juni 2006 im Europarat weiterführt, genehmigte die Änderung von Art. 26 der Satzung, dessen Text nachstehend wiedergegeben wird;
2. 2. Die Beratende Versammlung schlug dieselbe Änderung in einem Schreiben des Präsidenten der Beratenden Versammlung vom 9. Juni 2006 an den Präsidenten des Ministerkomitees vor;
3. 3. Nachdem diese Änderung durch beide Organe des Europarats genehmigt worden ist, tritt sie mit 14. Juni 2006, dem Datum der vorliegenden Bescheinigung, die den Regierungen der Mitglieder übersendet worden ist, in Kraft.

Der geänderte Text des Art. 26 lautet wie folgt:

„Die Mitglieder haben Anspruch auf die nachstehend angegebene Zahl von Sitzen:
